Samsung Electronics triumphs over Apple in Japan patents case

Samsung Electronics today scored a legal victory over Apple as the tech giants continue to wage a global battle over patents relating to their smartphones and tablet computers.

A Japanese court ruled Samsung had not breached an Apple patent involved in syncing of mobile devices and computers, Reuters reported.

Bloomberg said Apple has been ordered to pay the costs of the legal action.

"We welcome the court's decision, which confirmed our long-held position that our products do not infringe Apple's intellectual property," Samsung said in a statement.

The latest ruling comes a week after a US jury ordered Samsung to pay Apple $1.05 billion in damages for ?willfully? breaching six of seven patents for mobile devices.

A hearing has been set down for December 6, when the judge presiding over the case will hear Apple?s arguments for an injunction against the sale of Samsung mobile phones in the United States, the BBC reported.

The judge could also decide to triple the damages to more than $3 billion because the jury found the infringements were ?willful.?

Apple filed paperwork on Monday to ban US sales of eight Samsung mobile phones.

A South Korean court ruled last Friday that Samsung and Apple had infringed on each other?s patents and awarded damages to both companies.

Toshiba launches Canvio Personal Cloud, network-attached storage with iOS and Android apps

It's been a few years now that Toshiba's been making external hard drives, so it makes sense that the company would want to venture into larger disks as a next step. Indeed, the company just took the wraps off Canvio Personal Cloud, its first network-attached storage product. The drive itself will be offered in two flavors -- 2TB and 3TB -- but the hook, of course, is that you can use various apps to upload your files and then access them remotely. These applications include desktop software, as well as mobile apps for iOS and Android. In either case, the applications are designed to upload music, video, photos and documents, and all of this content is searchable by date and other filters. The drive will be available sometime next month, starting at $220 for the 2TB version and going up to $250 for 3TB. If you're curious, we've got hands-on photos of the UI past the break.

Japan's surprisingly weak industrial output darkens economic outlook

Industrial output dropped 1.2 percent in July compared with a median estimate for a 1.7 percent increase in a Reuters poll and followed a 0.4 percent gain in June.

In a further sign of trouble ahead, the purchasing managers index for August showed manufacturing activity contracted for a third straight month as domestic and external demand suffer.

Manufacturers said they expect output to rise only modestly in August and then fall again in September, which could increase the chance that the economy will contract in the third quarter and pressure policymakers to bolster growth.

"Exports to China and the European Union have been decreasing, so electronics parts makers are cutting back on production to adjust inventories," said Seiji Adachi, senior economist at Deutsche Securities.

"Forecasts for August and September show that output is on a downtrend."

Asia's other major exporters are also feeling the pinch from the slowdown in global demand. South Korea's industrial output, which closely tracks exports of smartphones, cars, ships and machinery, fell a larger-than-expected 1.6 percent in July from June, data showed on Friday.

The yen showed little response to the surprisingly weak industrial output and PMI data. But the downbeat figures underpinned benchmark 10-year JGB futures, which had opened up ahead of the output data.

"The Bank of Japan has to downgrade quite considerably their economic outlook going forward, given these figures, and I think this will put them in a very tight spot because they've already promised a 1 percent inflation rate," said Shogo Fujita, chief Japan bond strategist at Bank of America Merrill Lynch.

Manufacturers surveyed by Japan's trade ministry expect output to rise 0.1 percent in August and then decrease 3.3 percent in September.

The Markit/JMMA Japan Manufacturing Purchasing Managers Index (PMI) fell to a seasonally adjusted 47.7 in August from 47.9 in July. The index reached the lowest level since April 2011, one month after the earthquake struck Japan's northeast coast.

Japan's core consumer price index (CPI), which includes oil products but excludes volatile prices of fresh fruit, vegetables and seafood, in July fell 0.3 percent from a year earlier, separate data showed. That matched the median estimate, showing that deflationary pressure remains persistent.

The so-called core-core inflation index, which excludes food and energy prices and is similar to the core index used in the United States, fell 0.6 percent in the year to July, data from the internal affairs ministry showed.

Japan's economy has so far outpaced growth of most G7 countries on solid private consumption and reconstruction spending.

But exports in July posted the sharpest annual drop in six months, in line with trends seen in other export-driven Asian economies, casting doubt on Japan's recovery prospects.

The Bank of Japan frets that the timing of a recovery may be delayed, but wants to hold off on easing monetary policy again -- after having acted in February and April -- unless risks heighten enough to kill any chance of a recovery.

Should the economy require more fiscal stimulus, the policy response could be delayed as the government is locked in a dispute with opposition parties over foreign policy. (Additional reporting by Lisa Twaronite; Writing by Stanley White; Editing by Jacqueline Wong)

JPL and Will.i.am challenge young students to reach for the stars.

The?NASA?rover Curiosity beamed to Earth his new song "Reach for the Stars" on Tuesday in the first music broadcast from another planet, to the delight of students who gathered at the Jet Propulsion Laboratory to listen.

The song had been uploaded to the rover, which landed near the equator of?Mars, and played it back ? a journey of some 700 million miles (1,100 million kilometers).

The musician, who promotes science and mathematics education, was among more than a dozen celebrities who were invited to JPL to watch Curiosity's landing earlier this month. Others included Wil Wheaton, Seth Green and Morgan Freeman.

In 2008,?NASA?beamed the Beatles' "Across the Universe" into the cosmos to commemorate the 40th anniversary of the song.

Zacks has initiated coverage of University General Health System (UGHS - Analyst Report: OTCQB) with an Outperform rating and a target of $0.58. University General Health System is a multi-specialty health care provider that owns and operates a regional healthcare network in the Houston metropolitan area. The network is comprised of a core hospital and several complementary healthcare facilities, including eight hospital outpatient departments (HOPDs), one ambulatory surgical center (ASC) and three senior living facilities. Management is executing an aggressive growth plan to acquire additional facilities, further developing the company?s footprint in Houston. The company?s business model consists of the delivery of concierge, patient-oriented care by motivated physicians which currently own over 46% of the company.

Management?s strategic growth plan entails the creation and operation of regional health care networks developed around general acute-care host hospitals in other metropolitan areas, replicating the process employed in Houston. Each network is anticipated to be built through the acquisition of a host hospital and ancillary healthcare facilities within a radius such that they can operate under the hospital?s licenses as HOPDs. Each locally concentrated system would consist of a core hospital, along with HOPDs, ASCs, procedure facilities, diagnostic imaging centers, physical therapy clinics, among others. By consolidating health care providers into HOPDs, the University General network will benefit from higher reimbursement rates. In addition, the company?s physician-centric model allows the network to capture incremental revenues for procedures referred within the system. Initially, management plans to expand geographically within Texas.

During 2011, the University General acquired three senior living facilities, a support services organization that provides billing and other administrative services (Autimis) and a luxury hospitality service provider and facility management company (Sybaris). In addition, the company acquired 51% of the support services company that manages six senior living facilities and 15% of Mainland Surgery Center. So far in 2012, University General has acquired the Baytown Endoscopy Center, 1960 Digital Imaging (a diagnostic imaging and physical therapy center), three clinics (diagnostic imaging, physical therapy and sleep) located at the Kingwood Diagnostic and Rehabilitation Center and the Robert Horry Center for Sports and Physical Rehabilitation Center. University General Health System is expected to continue acquiring ancillary healthcare facilities in the Houston area in order to help fill out in its health care network, including free-standing emergency rooms, ambulatory surgical centers, diagnostic imaging centers, physician practices, post-acute skilled nursing facilities (SNFs) and other complementary facilities.

Through acquisitions and organic growth, total revenues increased 29.2% in 2011 to $72.5 million. Continuing the trend, during the first half of 2012, total revenues advanced 44.5% to $48.2 million over the comparable first half of last year. The company is also reporting double digit increases in the average daily inpatient census at University General Hospital.

Our price target of $0.58 is based on price-to-sales (P/S) and enterprise value-to-EBITDA (EV/EBITDA) valuation methodologies. University General is a small-capitalization company with a revenue profile that should experience rapid growth both through internal growth as the company?s hospital network is better utilized and through the execution of management?s aggressive acquisition strategy. The growing revenue stream has already manifested itself into positive earnings in the second quarter of 2012. Based on historical norms for similar specialty providers of hospital-related services companies, we expect UGHS to trade in an EV/EBITDA valuation range between 9.3 and 6.0, and specifically, our target is based on UGHS attaining the first quartile valuation benchmark of an 8.5 EV-to-EBITDA ratio due to the positive news flow of the successful implementation of management?s growth strategies. Also, valuation based on the price-to-sales metric confirms and reinforces the $0.58 price target. We expect UGHS to trade in a P/S valuation range between 2.0 and 1.0, which is also based on historical valuations of similar companies. The first quartile P/S valuation benchmark is 1.8 or $0.58 per share. Given management?s stated business plan of becoming a creator, owner and operator of regional health care networks in multiple metropolitan areas, University General is expected to expand its revenue base and level of profitability significantly.

Breakfast for Toddler is Special Mom Time

Considering I am done having babies, I savor every moment with my youngest. She is about to turn 3 in a few weeks and is my sidekick almost every day. When she wakes up we lay in bed and cuddle for a few minutes until she is ready to get up. Most days she is ready for food as soon as she rolls out of bed. Together we walk down the stairs to the kitchen and grab a bite to eat. This daily ritual is ours and I love sharing it with her. Breakfast with my toddler also means special Mom time. We sit at the table and ?talk? over our meals. Learning new words, colors, letters, numbers and more. Every morning is a new discovery.

Recently we have discovered that new textures and tastes can be overwhelming for our little Monkey. She will eat one kind of meat cooked one way and not another. She does not like jello but likes pudding. The textures of food for her have become in the forefront of our food choices for her? along with nutrition and taste of course. For instance, she loves oatmeal. But, we were interested to see how well she would like Beech-Nut Homestyle Oatmeal with Apples and Cinnamon. By introducing diced apples into the whole grain oats we already knew she enjoyed we were curious to see her reaction.

My husband and I buckled in Monkey after dropping off our new 1st and 3rd graders and headed out to Walmart. We knew we wanted to pick up some new Beech-Nut?products for her and a few things for dinner for us that we forgot over the weekend. Surprisingly the store was not packed and we were able to look through all of the toddler and baby foods without distraction. We did, though, offer Monkey some sippy cups to keep her distracted while we browsed the various foods. We were able to quickly grab what we needed in the baby area, a fast run through the grocery area for a handful of items, and then to the check out. Once home Monkey wanted her food! She pulled off her shoes and dress, grabbed a spoon, and sat down to eat. I quickly warmed up the Oatmeal and sat it in front of her as she climbed up to the table. After blowing it off a little, her first apple bite caught her a bit off guard and she spit the apple out. But, after explaining what it was and asking her to try again she actually liked it. A few bites more and she noticed a some other Goodies near by and went to try them as well.

Seal of Approval

Monkey loves her fruits. She will grab grapes and cherries out of the?refrigerator?and eat them all day if she could. So, we thought she would also enjoy the Strawberry Fruit Nibbles Goodies from Beech-Nut. Since she has always loved strawberries and we know she likes the texture of the snack we knew they would be a hit. With each bite she would simply say, ?Mmmmmm.? I believe that was her seal of approval on the Goodies. We had to put those far out of sight or she would have finished that box in one day.?We typically purchase the generic fruit snacks but I noticed that the Goodies were not as sticky, had more nutritional value, and Monkey ate them better than the others. I guess I never noticed them before but am glad we know where to find them now.

Plus, not only did she find the fruit nibbles, but she also noticed the Peach, Apple, and Banana Puree Fruities. Since she is used to eating applesauce from similar packets, she knew just what to do with it. I helped her open the Fruities On-the-Go and then she wasted no time sucking it down. Monkey may have liked the cool texture and great taste? but Mom liked that it included a full serving of fruit. Perfect for those days when she does not feel like a fruit snack from the fridge or cannot carry them with us on errands. I have a feeling we have found some new favorites to keep her little tummy full.

Overall I think she enjoyed her special breakfast time with mom? and dad this particular morning. I love being able to just spend those precious moments with her each morning before she grows too old to have time to sit with mom anymore. She is my baby and will always be. I am grateful that Beech-Nut offers essential nutrition for children her age and we can sit and eat a healthy breakfast together.

Bills in talks to acquire Seahawks QB Jackson

BUFFALO, N.Y. (AP) ? The Buffalo Bills are negotiating to restructure the final year of Tarvaris Jackson's contract before completing a trade with the Seattle Seahawks to acquire the seventh-year quarterback.

Seahawks coach Pete Carroll confirmed the deal had been agreed to by both teams Sunday, but added the trade wasn't completed.

"It has been agreed upon, but there is still a little bit of paperwork to do," Carroll said during a telephone conference call with reporters. "It might be done tonight. It is scheduled to be done."

A person familiar with discussions told The Associated Press that the Bills were in negotiations with Jackson's agent, Joel Segal, to restructure the player's contract. The person spoke on the condition of anonymity because neither team has disclosed why the trade had not yet been completed.

"It's close," the person said.

Jackson is scheduled to make $4 million this season, which the Bills deem to be too expensive for a player to fill a backup job.

Carroll didn't say what the Seahawks will get in return, though it's expected to be a mid- to late-round draft pick from Buffalo.

The Bills have no commented on the trade.

Jackson's future was in question with the Seahawks after the team acquired Matt Flynn in free agency this offseason, and after using a third-round pick to draft Russell Wilson in April.

The timing of the deal came shortly before Carroll announced that Wilson would open the season as the starting quarterback.

"Because of our situation, and the opportunity with the guys that we have, (Jackson) deserves a chance to be playing, so Buffalo came after him and hopefully it's a good thing for him," Carroll said.

Jackson sat out the Seahawks' first two preseason games, before getting his first action taking over for Wilson in the second half of a 44-14 win over Kansas City on Friday. And Jackson served as the backup in part because Flynn missed the game due to a sore elbow.

The Bills' interest in Jackson potentially spells trouble for Vince Young in his bid to win the backup job in Buffalo behind starter Ryan Fitzpatrick.

Young, who signed a one-year contract with Buffalo in May, had the edge to win the No. 2 job until he struggled in a 38-7 loss to Pittsburgh on Saturday. Young threw two interceptions, the first coming on his first pass attempt, and finished 12 of 26 for 103 yards passing in playing the entire second half.

Young had been competing with returning backup Tyler Thigpen for the No. 2 job. And coach Chan Gailey has maintained that there's only room for one backup, because the No. 3 job is going to receiver/wildcat specialist Brad Smith.

It would become the latest blow to Young's once-promising career. After leading Texas to win the national championship in 2006, Young was selected third overall in the draft by the Tennessee Titans and eventually went on to earn NFL offensive rookie of the year honors.

The Titans eventually ran out of patience for Young and released him last summer. Young had a disappointing season as Michael Vick's backup in Philadelphia last season.

He's 17-17 as a starter, with 38 touchdowns and 35 interceptions in 51 career games.

Selected in the second round of the 2006 draft by Minnesota, Jackson had an up-and-down five-year career with the Vikings. His most productive season came in 2007, when he started 12 games.

Jackson lost the starting job to Gus Frerotte the following season, and then spent 2009 and 2010 seasons relegated to backup duty behind Brett Favre.

Jackson signed a two-year contract with the Seahawks last year, and was credited for playing a major role in the team's turnaround after a 2-6 start. He posted career numbers in completions (271), attempts (450), 3,091 yards passing with 14 touchdowns and 13 interceptions.

Jackson also earned plenty of support among his teammates after playing most of the season with a painful pectoral injury.

Jackson has had his faults, with much of the criticism focusing in on his decision-making and holding onto the ball too long.

There were also times he faltered in the fourth quarter ? including late-season home losses to Washington and San Francisco ? which contributed to costing the Seahawks a shot at playoff berth.

Heyward, Minor lead Braves past Giants 7-3

SAN FRANCISCO (AP) ? Jason Heyward credits the crowd as much as anything for his success in San Francisco.

Heyward hit a three-run homer and Mike Minor won for the first time in five starts as the Atlanta Braves beat the Giants 7-3 on Saturday, ending San Francisco's five-game winning streak.

"The crowd always keeps you on your toes here and it's a good environment to play in," Heyward said. "They're always here, it's a good team and they have good pitching, so you have to focus every at-bat."

Heyward became the first left-handed hitter to take Madison Bumgarner deep in two years. The slugger has five home runs and 11 RBIs at the Giants' waterfront ballpark.

"I'm just looking for strikes to hit," Heyward said. "Don't miss the one you get to hit because if you do, he's got you."

Michael Bourn had two hits and drove in two runs for the Braves, who had lost six of seven but still lead the NL wild-card race. Reed Johnson and Martin Prado also knocked in runs.

Minor (7-10) gave up three runs and four hits in 6 2-3 innings, striking out five and walking none. He also doubled, walked and scored twice.

"I was just trying to get guys out and limit the damage," he said. "I felt good. It's not about being fatigued or anything like that."

Pinch-hitter Gregor Blanco had a two-run double for the NL West-leading Giants, who had won eight of 10.

Bumgarner (14-8) allowed four runs and seven hits over 6 1-3 innings. He matched his season high with four walks and struck out five, losing for only the second time at home.

"He's been so good all year and I thought he still pitched a pretty good game," Giants manager Bruce Bochy said. "He made one mistake and it went for a three-run homer."

Bumgarner walked Minor and Prado around a strikeout of Bourn in the third. Heyward smacked a home run into the right-field bleachers to put the Braves ahead 3-0.

"I kind of got out of whack there," Bumgarner said. "It was a fastball up and over the middle of the plate."

Hunter Pence was hit by a pitch leading off the fifth and scored on Brandon Belt's groundout to make it 3-1.

Bourn singled home a run in the seventh to make it 4-1.

"We had a good approach," Braves manager Fredi Gonzalez said. "I was ecstatic about Minor's performance. He minimized the damage and was dominant."

Blanco doubled off Chad Durbin to drive in two runs in the seventh.

Bourn and Prado each walked with the bases loaded against Jeremy Affeldt to force in runs in the eighth. Johnson doubled home a run in the ninth.

"It got a little sloppy there and we let the game get away," Bochy said.

Parliament could 'shut for 5 years'

The Houses of Parliament could close for up to five years while essential repairs are carried out, The Sunday Times said.

The broadsheet said several options were on the table while the plumbing and electrics are refurbished and the building is purged of asbestos, including leaving the Palace of Westminster for good.

"Officials are undertaking an initial study into options for the long-term upkeep of the palace," a spokesman for the House of Commons told the weekly.

"It is anticipated that the results of the initial study will be considered by the House of Commons commission and the House of Lords committee by the end of the year."

The Sunday Times said the Commons and the Lords could be evacuated for the first time since World War II, when the palace was repeatedly hit in Nazi air raids.

Options include leaving the palace, selling it and building a new parliament; a temporary replica chamber in the palace grounds; or, spreading the repair work out across decades of parliamentary breaks.

The interiors of the riverside Perpendicular Gothic palace, completed in 1870, have not been refurbished since the 1940s.

Parliament and the Treasury would have to approve the plans, the report said.
